This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from www.backbayaudio.com (the “Site”). 

Personal Information We Collect
Certain technical information about your visit (such as IP address, device type, browser, pages viewed, and referring URLs) is collected automatically by our ecommerce and analytics providers (such as Shopify and advertising/analytics partners) when you use our Site. We use this information only to operate and improve the Site, detect fraud, and measure marketing performance.

Additionally, when you make a purchase or attempt to make a purchase through the Site, we collect certain information from you (“Order Information”), such as your name, billing/shipping address, payment information (e.g. credit card numbers or other payment details), email address, and phone number.

Information You Provide
If you fill out a form on our Site, for example, a product warranty registration form or contact form,  we collect the personal information you choose to provide (“Form Information”). This may include your name, email address, phone number, and details about your purchase or product (such as product model, purchase date, retailer or order number), as well as any other information you submit on the form.

When we mention “Personal Information” in this Privacy Policy, we are referring to all of the above: Device Information, Order Information, and any Form Information you provide.

How Do We Use Your Personal Information?
We use Order Information to fulfill any orders placed through the Site (including processing your payment, arranging shipping, and sending you confirmations and invoices). Additionally, Order Information helps us to:
– Communicate with you about your order or account;
– Screen orders for potential fraud or risk; and
– When in line with the preferences you’ve shared with us, provide you with information or marketing regarding our products or services.

We also use information you provide through forms (such as warranty registrations) to carry out the purpose of the form. For example, if you register your product for warranty, we will use your provided details to register and confirm your warranty and to provide related customer support. Additionally, if you provide your contact information, we may use it to send you product updates, exclusive offers, and other marketing communications, in line with applicable law and the consent you’ve given. (For instance, if you provide your phone number, you consent to receive promotional text messages from us at that number. You can opt out of emails or texts any time, as described in this policy.)

Sharing Your Personal Information
Your Personal Information is automatically shared with third parties to help us use it as described above. For example, we use Shopify to power our online store, you can read about how Shopify uses your Personal Information here: https://www.shopify.com/legal/privacy.

We also use trusted service providers to operate our business. For instance, we may use Typeform to collect form responses, Google (e.g. Google Sheets) to store or organize data, and Klaviyo to manage our email and SMS marketing campaigns. These service providers act on our behalf and are also obligated to protect your information and use it only for our business purposes.

Finally, we may share Personal Information to comply with applicable laws and regulations; to respond to lawful requests (subpoenas, warrants); or to otherwise protect our rights.

We Do Not Sell or Share
We do not sell your personal information for money. However, like many companies, we use advertising partners that may collect information from our Site (via cookies or similar) to help deliver personalized ads. Under California law, this kind of sharing for “cross-context behavioral advertising” might be considered a “sale” or “sharing” of personal information. California residents have the right to opt out of this,  if you wish to do so, please see the “Your Rights” section below. (Using the opt-out links above or a browser-based do-not-track signal can also limit targeted ads.)

Do Not Track
Please note that we do not alter our Site’s data collection and use practices when we detect a Do Not Track signal from your browser. Because there is currently no consistent industry standard for handling “Do Not Track” signals, we continue to operate as explained in this policy. However, you can opt out of targeted advertising as noted above.

Your Rights
For European Residents: If you are a European Union or UK resident, you have the right to access the personal information we hold about you and to ask that it be corrected, updated, or deleted. You can exercise these rights by contacting us using the information below. Additionally, if you are in the EU/UK, we process your information to fulfill contracts we might have with you (for example, if you make an order through the Site) or otherwise to pursue our legitimate business interests listed above. And note, your information will be transferred outside of Europe, including to Canada and the U.S., as our business and some of our providers are based there.

For California Residents: If you are a California resident, you have specific rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA):
– Right to Know – You can request that we disclose what personal information we have collected about you, including the categories of information, sources, purposes, and any third parties we share it with.
– Right to Delete – You can request that we delete personal information we collected from you (unless an exception applies, such as if we need to keep data to fulfill a contract or comply with a legal obligation).
– Right to Opt-Out of Sale/Sharing – You can direct us not to sell your personal data or share it for targeted advertising. As noted, we do not sell data for money, but if you want to ensure we don’t share your data for advertising, you can opt out.
– Right to Non-Discrimination – We will not treat you differently or deny you services for exercising your privacy rights.
– Right to Correct – You can request we correct inaccurate personal information we hold about you.
– Right to Limit Use of Sensitive Information – (Though we typically do not collect sensitive personal info, if we did, you could limit our use of it.)

Exercising Your California Rights
To make any request under CCPA, whether to access, delete, or opt-out, please contact us at support@backbayaudio.com (you may also find a “Do Not Sell or Share My Info” link on our site footer). Please include your name and contact information, and describe your request. We will take steps to verify your identity (for example, by confirming control of your email address) before fulfilling the request. We will respond to your request within the timeframe required by law (usually within 45 days).

Data Retention
When you place an order through the Site or submit personal information via form, we will maintain your information for our records as long as necessary for the purposes given (for example, as long as you have an active warranty or until we’ve fulfilled the purposes of collection), unless and until you ask us to delete this information.

Changes
We may update this Privacy Policy occasionally to reflect changes to our practices or for other operational, legal, or regulatory reasons. The “Last Updated” date at the top will be revised accordingly. We encourage you to review this policy from time to time.
